Analysis: Oil reports may offer Obama an out on Iran (Reuters)

WASHINGTON (Reuters) ? President Barack Obama will soon get regular, albeit incomplete, reports on how oil markets are coping ahead of broader sanctions on Iran that could help him justify easing off sanctions to prevent a politically damaging jump in crude prices.

Under the latest Iranian sanctions signed into law late last year, the U.S. Energy Information Administration must begin issuing reports by Feb 29 and every two months after that on oil production and prices as the United States moves to squelch Iranian oil shipments.

The law imposes sanctions on financial institutions dealing with Iran's central bank. It's designed to rein in Iran's nuclear program by targeting its ability to sell oil, the country's lifeblood.

The administration has nervously moved ahead with sanctions as it negotiates with some of Iran's biggest customers to reduce their imports of its oil.

The irony is that while the sanctions were designed to hit Iran, global oil prices could rise due to rising tensions over the sanctions and that could trouble Obama.

The White House is bracing for a barrage of criticism if gasoline prices begin to rise with the onset of the summer driving season, according to one source close to the White House. If gasoline prices march towards $5 a gallon from more than $3.40 now, Republicans will attack just as Obama gears up for the November elections.

But Obama could use the EIA reports, which look at production and prices in countries besides Iran, to ease up on sanctions if they suggest energy security was at stake.

"If the president decides he doesn't want to impose the sanctions he's got a fig leaf," said Phil Verleger an economist and consultant with PKVerleger LLC. "He can hide behind the report."

Tensions between Iran and the West have been on the rise since the EU said this month it would embargo Iran's oil exports from July 1.

The International Monetary Fund has warned a supply disruption caused by the sanctions could push oil prices up by $20 to $30 a barrel, exacerbated by the thin oil stocks held by many consuming countries.

The Obama administration has time to decide if the EIA reports suggest prices will rise to an uncomfortable level. The EIA will issue three of the reports ahead of the June 28 deadline in the law that allows Washington to sanction foreign banks in countries such as China, India and South Korea that purchase petroleum from Iran.

INCOMPLETE DATA

Glen Sweetnam, who is in charge of the upcoming EIA report, said the agency has put a dozen workers on the reports, a bit more than for its usual reports on energy markets.

"What we are trying to do here is trying to provide an accurate picture as we can of the oil market and that's what we normally do," said Sweetnam.

Economists will be watching whether the February report gives insight on whether Saudi Arabia and the United Arab Emirates can make up for any shortfall if Iran shuts in production.

"One of the biggest parts of the debate is how much capacity does Saudi Arabia have to step in and make up for," losses in Iran's exports, said Michael Levi, a fellow at the Council on Foreign Relations.

But some doubt the EIA, riven by budget cuts, can give a complete picture of oil markets because of knowledge gaps especially in Asia, where demand has been growing the fastest.

"There are massive problems with the data," said Edward Morse, the global head of commodities research at Citigroup in New York. He believes the EIA could get a clearer snapshot if it get more money in the budget, but even then the picture would not be complete.

As the independent statistical arm of the Energy Department, the EIA is charged with compiling reports and forecasts free of influence from the administration.

The reports mandated by the sanctions law, however, will be done in collaboration with the Treasury and State Departments and the Director of National Intelligence. Those agencies will provide input before the reports are sent to Congress.

The collaboration could spark criticism that the administration influenced the study, a charge Sweetnam rejected because the EIA would be the final editor. "We decide what it's going to say," he said.

HARD TO HOLD FEET TO THE FIRE

Nevertheless, the EIA report could act as a political shield if Obama decided to temper the sanctions. Mark Dubowitz, a advocate for tougher Iran sanctions and head of the Foundation for Defense of Democracies, said it will be "difficult for Congress and for others to hold the administration's feet to the fire" if Obama used the EIA report as a reason to ease up.

George Lopez, an expert on international sanctions at University of Notre Dame, said Obama would have to tread carefully and not appear as being soft on Iran. But ultimately the president has much wiggle room.

"Previous presidents have dialed back on sanctions for reasons far less compelling to national security than high oil prices," he said.

PROVO, Utah ? Perimeter shooting was a strength for BYU earlier in the season.

Now it has become a weakness for the Cougars.

St. Mary's experienced no such trouble knocking down shots from the outside.

It proved to be the difference for the Gaels in earning an 80-66 victory over BYU on Saturday.

St. Mary's shot 7 of 18 from the perimeter while limiting the Cougars to just 2 of 13 from the 3-point line.

It is part of a prolonged drought from the perimeter for BYU.

This time, it cost the Cougars a shot at a victory that could have greatly enhanced their NCAA tourney profile going into March.

"We just need to knock them down," freshman point guard Matt Carlino said. "Sometimes teams go through droughts. Ours is coming in a tough spot."

Brad Waldow scored 19 points and Clint Steindl added 16 off the bench for the Gaels (21-2, 10-0), who took control early on both ends of the court to remain atop the WCC.

Rob Jones also added 13 points and nine rebounds to offset leading scorer Matthew Dellavedova, who was held to just 10 points.

Steindl scored 14 points in the first half when he hit his first four 3-point shots. He finished 4 of 6 from behind the arc.

The Cougars (18-6, 6-3) were led by Noah Hartsock and Carlino, who each scored 15 points. Brandon Davies added 14 points and seven rebounds.

St. Mary's used a 10-0 run to build a 40-28 halftime lead, and stretched the margin to 23 points early in the second half.

BYU cut the lead to nine, but could never get closer.

"We were prepared and we were ready to fight the storm," Waldow said.

The Gaels held off the Cougars in the second half in part because of a rugged defensive effort.

BYU struggled to mount a serious run because St. Mary's forced the Cougars to rush shots and kept things under control even when possessing the ball.

"It seemed like we couldn't run anything," St. Mary's coach Randy Bennett said. "We just had to hang onto the ball. What kept us in it is I thought we did a really good job of staying with what we were trying to do defensively."

St. Mary's and BYU spent most of the first half using their inside game.

The difference in the opening 20 minutes, however, was Steindl. With the game tied 13-13, Steindl came off the bench to hit his first 3 from the right corner to give the Gaels the lead.

The Cougars got back to 22-20 on a Hartsock score, but Waldow then broke loose for seven points in the paint and another Steindl 3 pushed St. Mary's to a 32-20 lead.

"St. Mary's played terrific, especially in the first half, by spreading us out and having multiple players make big shots and big plays," BYU coach Dave Rose said. "They got us to where we were rushing more like we did when we played over there."

After taking a 12-point lead into the break, St. Mary's widened the margin to 55-32 at the 16:49 mark of the second half when Dellavedova and Jorden Page each hit a 3 and Waldow added two more baskets in the paint.

The Cougars went on a 15-5 run to cut the St. Mary's lead to 60-47, but the teams traded baskets for the next several minutes to keep the Gaels' margin at 13.

Carlino scored five straight to make it 70-61.

St. Mary's was able to hang on, however, when BYU turned the ball over on two straight possessions and the Gaels hit 8 of 10 free throws down the stretch to finish things off.

"We just tried to make them make tough shots," Bennett said. "They're going to score and they're going to get the ball (inside) and you can't keep that from happening. So we just wanted to limit the number of easy baskets they got."

The Gaels shot 56 percent from the floor to only 41 percent for the Cougars.

St. Mary's also made 25 of 33 from the line. The Cougars were 14 of 22 from the line. St. Mary's won despite turning the ball over 24 times.

Twitter's new censorship rules face opposition (Reuters)

LOS ANGELES (TheWrap.com) ? It was only two weeks ago that Twitter was protesting online censorship in the form of anti-piracy bills SOPA and PIPA. Now the social networking site faces a surge of opposition to its own censorship practices.

Twitter announced in a blog post Thursday that it will now block specific tweets on a country-by-country basis should the messages violate the laws of those countries.

One of the worries is that Twitter has been a powerful tool in the protest movements that have surfaced across the globe in the past year, whether in the Arab Spring or the anti-austerity protests in Europe.

The fear is that the new policy will limit its utility in such instances.

Users have responded by promising to boycott the site on Saturday, and the media has blasted the company for what it views as blatant censorship.

Forbes' writer Mark Gibbs dubbed the move "social suicide" and many others have chimed in to voice their objection.

The boycott of Twitter is being promulgated by the hashtag #TwitterBlackout -- not all that different from the #SOPABlackout tweets from earlier this month. In another case of overlap with the SOPA/PIPA fight, hacking network Anonymous seems to oppose the move. Not known yet is whether it will act.

It's doubtful that enough people will stop using the service to have an impact, nor would a brief Twitter shutdown damage its business. However, the threats are clearly more about sending a message than crippling the now ubiquitous messaging platform.

The site's reasoning for the change was stated in its blog post: "As we continue to grow internationally, we will enter countries that have different ideas about the contours of freedom of expression. Some differ so much from our ideas that we will not be able to exist there."

Observers see this as Twitter caving to the power of oppressive and restrictive foreign governments. They don't want to anger those countries too much, lest they block Twitter.

To some, this is appalling. To others, it's just business.

Either way, Twitter finds itself on the other end of the censorship fight for one of the first times.

Israel says Iran 'drifting' toward nuke goal line (AP)

DAVOS, Switzerland ? Israeli Defense Minister Ehud Barak says the world must quickly stop Iran from reaching the point where even a "surgical" military strike could not block it from obtaining nuclear weapons.

Barak says tougher international sanctions are needed against Tehran's oil and banks so that "we all will know early enough whether the Iranians are ready to give up their nuclear weapons program."

Iran insists its atomic program is only aimed at producing energy and research, but has repeatedly refused to consider giving up its ability to enrich uranium.

Barak told reporters Friday in Davos, Switzerland that the situation is "urgent, because the Iranians are deliberately drifting into what we call an immunity zone where practically no surgical operation could block them."

DAVOS, Switzerland (AP) ? U.N. Secretary General Ban Ki-Moon urged a resumption of dialogue between Western powers and Iran on their nuclear dispute Friday, and said Tehran must comply with Security Council resolutions and prove conclusively that its nuclear development program is not directed to making arms.

"The onus is on Iran," said Ban, speaking here at a press conference during the annual meeting of the World Economic Forum.

"They have to prove themselves that their nuclear development program is genuinely for peaceful purposes, which they have not done yet." he said.

Ban expressed concern at the most recent report of the International Atomic Energy Agency that strongly suggested that Iran nuclear program, which it long has claimed is for development of power generation, has a military intent.

In spite of his tough words to Iran, Ban said that dialogue with the "three-plus-three" ? Germany, France and Britain plus Russia, China and the United States ? is the path forward.

"There is no other alternative for addressing this crisis than peaceful ... resolution through dialogue," said Ban.

Ban noted that there have been a total of five Security Council resolutions so far on the Iranian nuclear program, four calling for sanctions.

As tensions have been on the rise recently, some political leaders in Israel and the United States have been speaking increasingly of the possibility of a military strike to eliminate, or at least slow down, what they allege is a determined effort by Iran to obtain nuclear weapons.

Old mortgages rise from dead, haunt homeowners

In July 2009, Roy and Sheila Bowers refinanced the mortgage on their suburban ranch home in Topeka, Kansas. The couple wanted to take advantage of the low interest rates that were all the rage at the time.

Roy, a truck driver, and Sheila, a former hotel housekeeping supervisor, knew their new loan from Wells Fargo would enable them to save $198.86 a month - a nice chunk to help with gas and groceries.

But what the Bowers never imagined was that their old loan, the one Wells Fargo told them was paid off, would resurrect itself, trashing their credit report, scotching their son's student loans and throwing the whole family into foreclosure. All, they say, even though they didn't miss a single mortgage payment.

The Bowers aren't alone.

More and more, homeowners say that mortgages they thought were dead and buried are springing back to life, sometimes haunting them all the way into foreclosure.

"It's the most egregious manifestation of an industry that's seriously broken," said Ira Rheingold, a lawyer who is the executive director of the National Association of Consumer Advocate.

Foreclosures keep pushing house prices lower

Diane Thompson, an attorney with the National Consumer Law Center, says she has defended hundreds of foreclosure cases, and in nearly all of them, the homeowner was not in default. "The record-keeping on the part of the mortgage servicers is not to be trusted."

The problems grew from a lot of sloppy recordkeeping that began during the housing boom, when Wall Street built a quick-and-dirty back-office operation to process mortgages quickly so lenders could sell as many loans as possible. As the loans were later sold to investors, and then resold around the world, the back office system sidestepped crucial legal procedures.

Now it's becoming clear just how dysfunctional and, according to several state attorneys general, how fraudulent the whole system was.

Depositions from "affidavit slaves" depict a surreal, assembly-line world in which the banks and their partner firms hired hair stylists, fast-food kids and Wal-Mart floor workers, paying them $10 a day, to pose as bank vice presidents, assistant secretaries and corporate attorneys.

These "robosigners" became a national sensation in the fall of 2010 when it was revealed that they faked titles, forged documents and backdated affidavits so they could make up for the bypassed procedures and foreclose on properties.

They passed around notary stamps as if they were salt. They did all of this, they testified, without verifying a single word in any of the documents - as is required by law.

And it was all done, they say, to foreclose on as many homeowners as fast as possible.

Ensnared in mortgage hell
No one collects statistics on wrongful foreclosures, or how many people are facing the phantom mortgage debts. But as the industry enters its fifth year of unwinding its mortgage morass, consumer groups, homeowner attorneys and foreclosure-fraud investigators say they are seeing more cases where people who don't owe the banks a dime are getting ensnared in the same hell as those who have missed payments.

They add that such problems are likely to intensify. Former industry employees have testified that they knowingly pushed through foreclosures on the wrong people.

It all casts a pall over a housing market in worse condition than it was during the Great Depression. By some estimates, 12.5 percent of U.S. homes with mortgages are either in foreclosure or the loans are at least 30 days past due, representing about $1 trillion in value.

"This is an epic problem that the economy hasn't even begun to digest," said Florida foreclosure analyst Lisa Epstein.

In some cases, mortgages that were supposed to die off in a refinancing are popping back up, while in others, the loans were paid in full. Homeowners who pay off their houses through bankruptcy programs are also falling prey.

So are homeowners who never even had a mortgage to begin with.

Homeowners say the banks' repo men sometimes even show up at work. Banks also hector them with threatening letters and phone calls. "It scared the hell out of him," said a Houston lawyer whose client was the target of such efforts. "He was absolutely spooked," lawyer Barry Brown said.

So was Shantell Curtis of Utah. She showed up at her accountant's office last year only to learn that she had been sued for foreclosure on a house she had sold years before. Bank of America reported the delinquency to credit bureaus, tarring Curtis's credit. It turned out the entire saga stemmed from a bank coding error. The amount the bank falsely alleged Curtis still owed on her mortgage? One dollar.

Vietnam vet Dwight Gaines fell behind on his payments on his Birmingham, Alabama, home. Gaines paid off his entire mortgage, plus all the fees and expenses he owed the bank in March 2010, as a part of a Chapter 13 bankruptcy plan. But Bank of America kept sending Gaines notices that he still owed $6,842.37. Nearly two years later, Gaines is still fighting the bank in court.

"In my experience, if I had not sued Bank of America, they would have eventually placed Mr. Gaines in foreclosure although he had completely paid his mortgage," said Gaines' lawyer, Wesley Phillips.

Bank of America spokeswoman Jumana Bauwens said the bank is working to resolve the Gaines situation. She also said that "these situations pre-date a review of our foreclosure procedures which took place in the fall of 2010. At the time, we identified areas of our process that needed to be improved, and we have been making those improvements."

Mounting pile of probes
The reincarnating mortgage is only the latest development in the megabanks' mortgage debacle, a scandal that has made them the target of a mounting pile of investigations and lawsuits. Though a settlement with most of the U.S. attorneys general may be imminent, a rogue group of AGs has peeled off to launch their own investigations.

One of those AGs, New York's Eric Schneiderman, is a part of the U.S. Justice Department task force announced by President Obama in his State of the Union address on Tuesday night.

Up until Obama's announcement, the federal government's response to the alleged financial misconduct was in the form of an independent review of the banks overseen by the federal Office of the Comptroller of Currency. But critics have labeled the OCC review as a farce rife with conflicts of interest.

The OCC spokesman, Bryan Hubbard, disputed that claim, saying the OCC has gone to great lengths to ensure that the independent consultants hired by the banks to review their procedures would report to regulators, not the banks. "During the selection process of the independent consultants and law firms, regulators rejected some proposed consultants and law firms to prevent conflicts of interest," said Hubbard.

Such reviews are supposed to gather information from homeowners like Jennifer Wilson, a former nursery school teacher from Philadelphia. Wilson settled a wrongful foreclosure case with Wells Fargo in June 2010. That month, court records show, Wells Fargo filed a satisfaction of mortgage document noting that the $8,000 loan on Wilson's home had been paid in full.

But more than a year later, on Dec. 8, 2011, Wilson, who is disabled and lives below the federal poverty line, answered her door to see a process servicer brandishing foreclosure warning papers from Wells Fargo. The bank's letter warned Wilson that she owed 57 months of late payments, plus expenses, totaling $18,407.55. If she did not pay within 30 days, the bank said, it would sue for foreclosure.

"I thought I'd been punked," said Wilson. Even more bizarrely, one day later, a different process server from a different company showed up on Wilson's door and handed over the exact same papers Wilson had received the day before.

"We see a lot of cases like this, where they are trying to collect even though there is no

Zusi's goal lift US men to 1-0 win over Panama

Five months before the start of World Cup qualifying, the United States got an exhibition win in Central America under some of the conditions the players will face on the road to the 2014 tournament in Brazil.

Graham Zusi scored his first international goal in the eighth minute, and the Americans beat Panama 1-0 Wednesday night at Panama City for their third straight win.

"We wanted to introduce the players to those difficult games in different environments, especially away from home outside of their comfort zone," U.S. coach Jurgen Klinsmann said. "We wanted them to come here and experience this atmosphere and a different way of doing things. I think they did very well with all that."

Using mostly backups while the regulars remained with their European clubs and playing nearly the entire second half a man short, the Americans evened their record at 4-4-1 under Klinsmann, who replaced Bob Bradley as coach last summer.

"It was fun. The crowd was great. It was a fun environment to play in," Zusi said. '

Panama, which upset the U.S. in the first round of last year's CONCACAF Gold Cup, had a man advantage after Geoff Cameron received a red card in the 52nd minute for shoving Blas Perez from behind on a breakaway just outside the penalty area.

Perez nearly tied it in the 78th but sent a short downward header wide.

"In the first half I think we were the better team," said midfielder Jermaine Jones, who served as the U.S. captain for the second straight match. "The second half was difficult because we were a man down and Panama pushed hard."

Other than the goal, the Americans rarely threatened ? the U.S. didn't have its first corner kick until the fifth minute of stoppage time in the second half, just before the final whistle.

Goalkeeper Nick Rimando, making his first national team appearance in a year, had several difficult saves to prevent the hosts from scoring. The U.S. was coming off a 1-0 win over Venezuela on Saturday at Glendale, Ariz., its first victory over a South American opponent in nearly five years.

"To get two victories and come down to Central America and beat Panama is huge," Rimando said. "It's a testament to all the hard work everyone has put in."

During a three-week training camp, Klinsmann got to test the depth of his player pool as the Americans prepare for their opening qualifier, on June 8 against Antigua and Barbuda.

"It was good to help us prepare for what we will see in World Cup qualifying," midfielder Brek Shea said. "It's a battle. It's not always pretty, but you have to get the results."

Most of the top American players will return for the next game, an exhibition against Italy at Genoa on Feb. 29.

Zusi, a 25-year-old midfielder with Major League Soccer's Sporting Kansas City, made his national debut last weekend. His goal came after left back Zach Loyd's cross fell at Teal Bunbury at the top of the 6-yard box and appeared to bounce off him to Zusi, who slammed it in with a right-footed shot from 7 yards.

"Zach sent a ball in that took a fortuitous bounce in my direction, and I was just there to clean it up," Zusi said. "It's a cool experience to get that first goal, but the win is still the most important thing."

Rimando dove midway through the first half to block Luis Renteria's point-blank shot, which bounded in front of the net. Rimando then got up and managed to poke the ball away before the rebound could be knocked in.

Jones nearly made it 2-0 in the 30th, but goalkeeper Luis Mejia parried his 30-yard shot, then dived back to save Chris Wondolowski's header at the goal line. Five minutes later, Rimando athletically got his left leg out to block Perez's close-range shot.

"Our team had a very hard three weeks, and they had tired legs today and you could see that," Klinsmann said. "A lot of the young players learned their lesson today."

Gaza Hamas leader leaves next week for Egypt, Iran (AP)

GAZA CITY, Gaza Strip ? The Hamas prime minister's office says the Gaza premier will be visiting Iran as part of his tour of Muslim countries next week.

Ismail Haniyeh will make Cairo his first stop on January 30. He will also visit Kuwait, Bahrain and Qatar.

Israel says Iran backs Hamas with funds and smuggled weapons.

Earlier this month Haniyeh toured Egypt, Sudan, Turkey and Tunisia. That was the first time he left Gaza since Hamas seized control of the territory from the rival Fatah movement in 2007.

Hamas says the visits prove that it has won increased international recognition and that Islamic groups in the region have more influence.

The Palestinian Authority, which is dominated by Fatah, has been concerned by the warm welcome Haniyeh has received.

It's guys, not ladies, who splurge on lunch

The next time you stop in for a morning latte or head out for a restaurant lunch, take a look around ? and don?t be surprised if you see a lot of young men standing in line.

A new survey of workers finds that men spend significantly more on coffee and lunch than women.

The survey, from staffing firm Accounting Principals, also found that younger workers spend more than older workers on lunch and coffee during the workday.

Overall, those lunches out and coffee breaks are costing workers a bundle.? American workers who buy coffee and lunch spend an average of $1,000 a year on coffee and $2,000 a year on lunch, based on the survey of 1,000 workers.

About two-thirds of workers buy lunch and half buy coffee during the week.

Men were slightly more likely than women to go out to eat, but they spent a lot more. The men who buy their lunches spend an average of $46.30 on lunch each week, compared with $26.50 for women who go out to eat.

Men who buy coffee spend an average of $25.70 vs. $15 for women.

The caffeine fix is a bigger hit on the wallets of 18- to 34-year-old workers. Younger workers who buy coffee spend an average of $24.74 a week on coffee, compared with $14.15 for workers 45 and older who buy coffee during the work week. Younger workers also spend far more on lunch than older workers: about $45 a week vs. $32.

Not surprisingly, a third of those surveyed said one of their goals for 2012 was to bring their own lunch more often.

Accounting Principals, a unit of Adecco, commissioned the survey in December.

Joe Paterno, revered coach tainted by scandal, dies (Reuters)

STATE COLLEGE, Pennsylvania (Reuters) ? Penn State football coach Joe Paterno, the winningest coach in major college football history who was fired in November over a child sexual abuse scandal involving an assistant that rocked America, died on Sunday of lung cancer. He was 85.

Paterno won adoration from fans of the highly successful and profitable Penn State football program and they unleashed invective at the university board of trustees who fired him unceremoniously after 46 years as head coach, tarnishing his outsized legacy.

Equally outraged were his critics and advocates for victims of sexual abuse who faulted Paterno for his relative inaction upon hearing an accusation that former defensive coordinator Jerry Sandusky had sexually abused a young boy in the Penn State football showers in 2002.

Paterno told university officials but not police, opening him to criticism that he protected an accused child molester for nine years.

Sandusky, 67, who has maintained his innocence, faces 52 criminal counts accusing him of sexually abusing 10 boys over 15 years, using his position as head of a The Second Mile, a charity dedicated to helping troubled children, to find his victims. The court placed him under house arrest.

Waves of mourners descended on a makeshift shrine to Paterno outside the university's Beaver Stadium. They draped an American flag on a statue of Paterno and wrapped its neck with a Penn State scarf.

Sobbing at the statue's feet was Dana Gordon, a 1982 graduate who blamed the school's Board of Trustees for hastening Paterno's death by firing him in a "callous way."

"The way the board treated him took a lot of the fight out of him," Gordon said.

The case raised questions about the measures the university took to protect Sandusky and a football program that Forbes magazine estimated made a profit of $53 million in 2010, especially since accusations against him first surfaced in 1998. At that time a university police detective admonished Sandusky to stop showering naked with boys but stopped short of bringing criminal charges.

One of the biggest scandals in college sports history, it provoked a national discussion about pedophilia in the same way charges involving Roman Catholic priests did years earlier.

The matter also drew impassioned arguments about the balance between protecting the young and the rights of criminal defendants, who are presumed innocent until proven guilty.

"I hope his passing and the controversy surrounding Sandusky will deter other people, especially powerful people, from covering up child sex crimes," said David Clohessy, director of Survivors Network of those Abused by Priests, a support group.

"Even decades of professional achievement should not obscure dreadfully reckless and callous inaction that results in child sex crimes," Clohessy said.

Sandusky issued a statement sending condolences to the Paterno family that did not mention the investigation.

"Nobody did more for the academic reputation of Penn State than Joe Paterno. He maintained a high standard in a very difficult profession," Sandusky said.

Paterno won a reputation for making sure his players graduated and one of the program's mottos was "Success With Honor."

Paterno's downfall was spectacular. For decades he was a symbol of vitality who patrolled the Penn State sidelines with unchallenged authority, easily recognizable by his thick eyeglasses and jet-black hair that only showed a hint of gray in his later years. His two national championships, in 1982 and 1986, won him enduring loyalty from fans who affectionately called him "JoePa."

In the end, he was confined to a wheelchair upon breaking his hip in a fall one month after being fired, and he wore a wig after losing his hair to chemotherapy, according to the Washington Post, which interviewed Paterno about a week before his death.

Paterno was surrounded by family when he died 9:25 a.m. on Sunday of metastatic small cell carcinoma of the lung, Mount Nittany Medical Center said in a statement.

IMPACT ON CRIMINAL CASE

Paterno's death may not significantly affect the case against Sandusky, but was more likely to weaken the criminal case against two university officials charged with perjury, at least one legal expert said.

Paterno learned of at least one accusation against Sandusky in 2002, when graduate assistant Mike McQueary told Paterno he witnessed Sandusky molesting a boy of about 10 years old in the showers of the Lasch Football Building.

Paterno told university officials but not police, a decision that ultimately led to his downfall.

Paterno, in an interview with the Washington Post published on January 14, said he was uncertain how to handle the matter and trusted the university administration.

Paterno testified before the grand jury that he informed former athletic director Tim Curley about what McQueary told him. About 10 days later, McQueary testified, he was called to a meeting with Curley and university finance official Gary Schultz to discuss what happened.

Curley and Schultz both face perjury charges based on their inaction. Schultz also testified before the grand jury he was aware of the 1998 investigation of Sandusky.

University President Graham Spanier was fired along with Paterno, and Curley and Schultz stepped down.

"If he (Paterno) had known the devastation that this means, he would have reacted differently," said Peter Pelullo, founder of Let Go, Let Peace Come In, a support group helping some of Sandusky's accusers with counseling.

"If there had been an auto accident on the Penn State campus and a kid had been run over, everybody would have called 911. That boy was being crushed at the moment he was in the shower with Sandusky. It's not just Joe Paterno but the rest of the country that didn't understand this," Pelullo said.

Because Paterno was not believed to have witnessed any purported abuse, his testimony would not have been crucial to Sandusky trial, said Paul Callan, a former prosecutor and criminal defense attorney.

But his death could set back the criminal case against Curley and Schultz.

"The Confrontation Clause (of the constitution) guarantees that criminal defendants will have the right to confront and cross-examine the witnesses against them at the time of trial," Callan said. "No defense attorneys were present at the grand jury proceedings to do such a cross-examination."

Max Kennerly, a Philadelphia trial lawyer who has followed the case, said Paterno's death was unlikely to alter any civil litigation being contemplated by Sandusky's accusers. If any were considering suing Paterno, they could just name his estate.

"Death doesn't change your status as a party," Kennerly said.

Elusive Z- DNA found on nucleosomes

New research published in BioMed Central's open access journal Cell & Bioscience is the first to show that left-handed Z-DNA, normally only found at sites where DNA is being copied, can also form on nucleosomes.

The structure of DNA which provides the blueprint for life has famously been described as a double helix. To save space inside the nucleus, DNA is tightly wound around proteins to form nucleosomes which are then further wound and compacted into chromatin, which is further compacted into chromosomes.

But this familiar image of a right handed coil (also called B-DNA) is not the only form of DNA. At sites where DNA is being copied into RNA (the messenger which is used as the instruction to make proteins) the DNA needs to unwind, and, in a process of negative supercoiling, can form a left-handed variety of the DNA double helix (Z-DNA).

It was originally thought that Z-DNA could only be formed in the presence of active RNA polymerase (the enzyme which assembles RNA). However more recently it has been discovered that SWI/SNF, a protein involved in remodeling nucleosomes and allowing RNA polymerase access to DNA, can convert certain sequences of B to Z-DNA.

The team of researchers led by Dr Keji Zhao discovered that they could convert B-DNA to Z-DNA on nucleosomes by the addition of SWI/SNF and ATP (the cell's energy source) and that the Z-nucleosome formed was a novel structure.

Dr Zhao, from the NIH, explained, "The fact that we have found Z-DNA on nucleosomes is a new step in understanding the roles of chromosome remodeling and Z-DNA in regulating gene expression. While the Z-nucleosome is likely to be a transient structure it nevertheless provides a window of opportunity for the placement of DNA binding proteins which may recruit, regulate, or block the transcription machinery and hence protein expression."

It's complicated: Romney struggles to talk wealth

(AP) ? Mitt Romney is no natural when it comes to "common man" politics.

He bets a Republican rival $10,000 on an impulse. He dismisses $373,000 in speaking fees as "not very much." And he slow-walks the release of his income tax returns but then blurts out a key fact: He pays about 15 percent of his income in taxes because he lives mostly on investment income and not a paycheck.

Such commissions of candor suggest a presidential candidate who is far from an everyman ? and who may have a tin ear for how he sounds to those who are. That could pose a special challenge to Romney in hard-hit Florida, and beyond. In a general election, Romney, who had a privileged upbringing and made millions as a venture capitalist, would be fighting for the votes of average Americans against a president whose mother at times drew food stamps and who worked his way through Harvard Law School to the pinnacle of power.

"When Barack Obama talks about paying off student loans and struggling, people believe him and it resonates," said Barbara Perry, a senior fellow at the University of Virginia's Miller Center. Historically, "the common people have to believe that the president knows them and knows their situation and knows their lives."

Republicans hope that in 2012, American voters struggling to get jobs and pay bills are looking past the candidates' personal stories and to their proposals for stabilizing the economy and cutting the nation's staggering debt.

"Barack Obama had an incredible emotional connection with the American people in 2008," said South Carolina Republican consultant Jim Dyke. In the worst economy since the Great Depression, "that connection has dissipated," he added. "The American people may be more interested in a credible plan to address our problems."

The ranks of presidential candidates, and presidents, throughout history are full of American aristocrats, from George Washington to the Roosevelts, Rockefellers, Kennedys and Bushes. Some won by using policy and rhetoric to win support from lower-income voters, a practice that became known as the politics of the common man after Andrew Jackson's 1828 campaign. He won in part by portraying the nation's central bank as an institution that mostly made rich people richer.

So it's possible to run for president, and even win, while wealthy. Indeed, polls suggest that Americans don't begrudge Romney's family fortune or his own success in the private sector. In an AP-GfK survey last month, for example, about half of the respondents said Romney "understands the problems of ordinary Americans." Roughly the same percentage felt that way about Obama.

And efforts to portray Romney as a "vulture capitalist" fat cat at Bain Capital may have backfired against Newt Gingrich and Rick Perry, the Republican rivals who launched them. Perry dropped out of the contest on Thursday.

There's evidence that Romney himself is learning to edit out offhand remarks that may be genuine yet jarring to average voters. In a debate Thursday night, Romney referred to having his tax returns "carefully managed," but mostly stayed clear of lifestyle details.

Instead, he equated his wealth with all-American achievement and upward mobility ? the opposite of coasting on his father's success as head of American Motor Corp., Michigan governor and federal housing secretary.

"What I have, I earned. I worked hard, the American way," Romney said to cheers and applause. "I'm not going to apologize for being successful."

It was a refinement of the way Romney has handled the central challenge of his campaign: winning over people struggling to keep their houses and find work when his own background is so far removed. Making it tougher is that the 2012 contest is happening against a backdrop of anger over income disparity, with "99 percenters" protesting policies that help the wealthiest 1 percent of Americans ? including Romney.

And where the Roosevelts and Kennedys won over ordinary people with social policies like the New Deal, Romney is campaigning on a plan to stabilize the economy through investments and tax breaks for "job creators," including the wealthiest individuals.

"Wealthy Democrats can get away with being wealthy so long as they espouse policies favorable to ordinary folks. Wealthy Republicans, by contrast, take a hit when their policies seem to favor the wealthy," said presidential historian H.W. Brands of the University of Texas. "It's the policies that really matter. The personal history is fluff."

Still, Romney has struggled to strike the right note with the masses.

In New Hampshire last month, he suggested that he's feared job setbacks at various points in his career.

"I know what it's like to worry about whether you're going to get fired. A couple of times I wondered if I was going to get a pink slip," Romney said during a campaign stop in Rochester, NH.

But it's highly unlikely he's ever felt the fear of being let go, or of being unable to find work, without a family fortune to fall back on.

Romney's refusal to release his tax forms put a fine point on the issue.

He grudgingly acknowledged that he might, for the first time, release them. But only one year's worth, and not until April, if he is the GOP's presidential nominee. He did reveal that he pays an effective tax rate of 15 percent, lower than what he would pay if he earned a regular pay check. He then disclosed that he earned speaking fees, "but not very much." The amount turned out to be $373,327.62 from 2010-2011.

In New Hampshire, a day after the pink slip remark, he spoke of the importance of having a choice of health insurance companies and declared, "I like being able to fire people who provide services to me."

And in a heated debate last month, Romney bet Perry "10,000 bucks," apparently on impulse, when he could have wagered a symbolic dollar, or a beer.

Romney will soon get some practice honing his personal story in a state where he would need to be a master of it in the general election. After the South Carolina primary on Saturday, Romney and the GOP field move to Florida, a massive swing state familiar with the toxic cycle of high unemployment, unpaid bills, home foreclosures and despair.

It's no coincidence that Obama announced a new economic initiative there Thursday. The state suffers from 10 percent unemployment, and more than half of its homeowners owe more on their mortgages than their properties are worth.

In Florida and beyond, Romney may find that sometimes it's best to keep his thoughts to himself.

"Don't try to stop the foreclosure process," he told the Las Vegas Review Journal in October, describing ways to improve the housing market. "Let it run its course and hit the bottom."

Rainforest in Transition: Is the Amazon Transforming before Our Eyes?

The Amazon rainforest is in flux, thanks to agricultural expansion and climate change. In other words, humans have "become important agents of disturbance in the Amazon Basin," as an international consortium of scientists wrote in a review of the state of the science on the world's largest rainforest published in Nature on January 19. (Scientific American is part of Nature Publishing Group.) The dry season is growing longer in areas where humans have been clearing the trees?as has water discharge from Amazon River tributaries in those regions. Multiyear and more frequent severe droughts, like those in 2005 and 2010, are killing trees that humans don't cut down as well as increasing the risks of more common fires (both man-made and otherwise).

The trees are also growing fast?faster than expected for a "mature" rainforest?according to a network of measurements.

The exact cause or causes of this accelerated growth?which means the Amazon's 5 million square kilometers of trees are now sucking in and sequestering some 400 million metric tons of carbon per year, or enough to offset the annual greenhouse gas emissions of Japan?"remains unknown," the researchers wrote in the review.

"When we measure that a particular stand of mature forest is accumulating carbon, it is difficult to say whether that might be due to recovery from some unrecognized disturbance long ago or whether it is due to more recent changes in climate and CO2," explained Woods Hole Research Center Senior Scientist and Executive Director Eric Davidson, lead author of the review, in an e-mail. Candidates include recovery from the potential wide-scale disturbance by pre-Columbian human societies now beginning to be uncovered or the increasing availability of some formerly limiting factor, such as atmospheric carbon dioxide.

In fact, increasing levels of CO2 in the atmosphere?now roughly 392 parts per million and rising?may be fertilizing the rainforest and preventing even greater impacts from reduced rainfall, although this question, Davidson and his colleagues wrote in the review, "may be one of the largest unknowns for the future of the Amazon forests."

What is known is that the forest clearing that has already gone on is decreasing forest rainfall. The Amazon produces roughly a third of its own precipitation?trees release moist air that then falls back as rain to nourish other trees (the rest comes from the Atlantic Ocean). But the air above cleared land warms faster and therefore rises more quickly, drawing the moist air from surrounding forested areas away. In fact, the conjunction of cleared and forested lands actually creates wind known as a vegetation breeze. But that breeze tends to blow rainfall away from the forest and over the surrounding pastures instead. It also weakens the continental-scale low-pressure system that draws rainfall over the Amazon.

The southern and eastern portions of the Amazon are the most affected, according to this review. For example, the southeastern Amazon around one of the local tributary rivers?the Tocantins?has seen pasture and cropland increase from 30 percent to 50 percent of the land between 1955 and 1995. As a result, that river now carries 25 percent more water. Another southeastern tributary, the Araguaia, now carries 28 percent more sediment?precious soil lost during downpours from surrounding, expanded agricultural fields.
